Notice on Video Surveillance

Pursuant to Article 76, Paragraph 3 of the Personal Data Protection Act (Official Gazette of the Republic of Slovenia, No. 163/2022, ZVOP-2)

1. VIDEO SURVEILLANCE OPERATOR AND PERSONAL DATA CONTROLLER

2. PURPOSE OF VIDEO SURVEILLANCE

Video surveillance is conducted for the following purposes:

  • To protect people and property
  • To monitor business processes
  • To control entry and exit to and from the company’s premises

3. INFORMATION REGARDING THE IMPLEMENTATION OF VIDEO SURVEILLANCE

  • No additional processing of video recordings is conducted.
  • Video recordings are not transferred to third countries.
  • No audio is recorded as part of the video surveillance.
  • Live video feed is accessible exclusively to authorized personnel of the controller.
  • Video recordings are retained for a maximum period of 2 months.
  • The legal basis for the implementation of video surveillance, including the monitoring of live feeds, is the legitimate interest of the controller to ensure the safety of people and property, monitor business processes, and control access and exit.

Collected Personal Data:

  • Video recording (image) of the individual
  • Location of the recording
  • Date of the recording
  • Time of entry, exit, or movement within the monitored area

4. INDIVIDUAL RIGHTS REGARDING PERSONAL DATA PROCESSING

Individuals have the following rights related to their personal data. Dom dva topola will verify the identity of any individual exercising these rights.

Requests can be submitted via email to recepcija@floramare.si or mail to Dom dva topola d.o.o., Levstikova 1, 6310 Izola.

Dom dva topola d.o.o. will respond to justified requests within 1 month. If a request is complex or if multiple requests are received, the deadline may be extended by up to 2 additional months. Individuals will be informed of any extension and the reasons for it.

4.a) Right of Access to Data:

On request, individuals will be informed whether their personal data is being processed and, if so, will be provided with:

  • The types of personal data
  • The categories of recipients to whom the personal data has been or will be disclosed
  • The data retention periods
  • A copy of the processed personal data will also be provided upon request.

4.b) Right to Erasure (Right to be Forgotten):

An individual may request the erasure of their personal data in the following situations:

  • The data is no longer necessary for the purposes for which it was collected
  • The individual withdraws consent (where applicable) and no other legal basis exists for processing
  • The individual objects to the processing and no overriding legitimate grounds exist for processing
  • The personal data was unlawfully processed
  • The data must be erased to comply with EU or Slovenian law

4.c) Right to Restriction of Processing:

An individual may request restriction of processing if:

  • The accuracy of personal data is contested (for a period enabling verification)
  • Processing is unlawful and the individual opposes deletion
  • Dom dva topola no longer requires the data, but the individual needs it for legal claims
  • The individual has objected to the processing and verification of legitimate grounds is pending

4.d) Right to Data Portability:

An individual may request the transfer of their personal data in a machine-readable format, which can be collected at the registered office of Dom dva topola d.o.o.

4.e) Right to Object:

An individual has the right to object to the processing of their personal data by the controller in the scope of video surveillance based on legitimate interest as per the General Data Protection Regulation, Personal Data Protection Act (ZVOP-2), or other applicable legislation.

5. RIGHT TO FILE A COMPLAINT REGARDING PERSONAL DATA PROCESSING

An individual may submit any complaints regarding the processing of their personal data to:

Additionally, individuals have the right to lodge a complaint directly with the Information Commissioner of the Republic of Slovenia if they believe that their personal data has been unlawfully processed.
